Welcome to Gymzie (“Website”), a brand owned and operated by Isha Global Ventures (“Company”, “Gymzie”, “we”, “our”, or “us”).

These Terms & Conditions (“Terms”) govern your access to and use of the Website, including all purchases, services, products, features, content, and functionalities offered through the Website.
 

By accessing, browsing, registering on, or using the Website in any manner, you (“User”, “Customer”, “you”, or “your”) agree to be legally bound by these Terms, along with our Privacy Policy, Shipping Policy, Return, Replacement & Refund Policy, and any other policies published on the Website.

If you do not agree with these Terms, you must discontinue use of the Website immediately.

However:

  • Minor variations in color, texture, appearance, fit, or finish may occur due to lighting, photography, screen settings, or manufacturing variations

  • Product availability is subject to stock limitations

  • Display of products on the Website does not guarantee availability or order confirmation

  • Errors relating to pricing, descriptions, or technical information may occasionally occur

Gymzie reserves the right to modify, discontinue, update, or revise products, pricing, availability, offers, and specifications without prior notice.

 

4. Pricing & Payments

  • All prices displayed on the Website are in Indian Rupees (INR) unless otherwise specified

  • Applicable taxes and shipping charges shall be reflected at checkout, wherever applicable

  • Payment must be completed using approved payment methods available on the Website

  • Orders shall only be processed upon successful payment authorization

Currently, Cash on Delivery (“COD”) services are not available.

Gymzie reserves the right to refuse, cancel, or hold transactions suspected to be fraudulent, unauthorized, suspicious, or in violation of these Terms.

 

5. Orders & Acceptance

Placing an order on the Website constitutes an offer to purchase products subject to acceptance by Gymzie.

Gymzie reserves the right to:

  • Limit quantities purchased per customer/order

  • Cancel orders due to:

Orders once dispatched cannot be cancelled.
 

6. Shipping & Delivery

Shipping and delivery timelines displayed on the Website are estimated timelines only and may vary depending upon location, courier availability, operational circumstances, or unforeseen events.

Gymzie shall not be liable for delays arising from:

  • Natural disasters

  • Transportation disruptions

  • Lockdowns or governmental restrictions

  • Courier partner delays

  • Technical failures

  • Events beyond reasonable control

Risk and ownership of products shall pass to the customer upon successful delivery.

Customers are advised not to accept tampered or damaged parcels and must report such issues immediately with supporting proof.


7. Returns, Exchanges & Refunds

All returns, exchanges, replacements, cancellations, and refunds shall be governed by the official Return, Replacement & Refund Policy available on the Website.

By placing an order, you acknowledge and agree to such policies.

Where users voluntarily share photographs, videos, testimonials, feedback, reviews, social media tags, mentions, or other content with Gymzie through any platform, users grant Gymzie, a brand owned and operated by Isha Global Ventures, a non-exclusive, royalty-free, worldwide, perpetual right to use, reproduce, display, publish, modify, repost, or distribute such content for promotional, advertising, marketing, operational, or commercial purposes.

Users represent that they own or possess necessary rights over such content and that such usage shall not violate third-party rights or applicable laws.


11. Marketplace & Future Services

Failure by Gymzie to enforce any provision, right, or remedy under these Terms shall not constitute a waiver of such right or provision.

No waiver by Gymzie shall be deemed a continuing waiver unless expressly provided in writing.


24. Entire Agreement

These Terms, together with the Privacy Policy, Return, Replacement & Refund Policy, Shipping Policy, and any other policies published on the Website, constitute the complete and entire agreement between the user and Gymzie concerning use of the Website and related services.


25. Governing Law & Jurisdiction

These Terms shall be governed and interpreted in accordance with the laws of India.

Any disputes arising out of or relating to these Terms, Website usage, or purchases shall be subject to the exclusive jurisdiction of the competent courts located in Nagpur, Maharashtra, India.
